UAE Labour Law
Key Employee Rights

Under UAE Federal Decree-Law No. 33 of 2021 on the Regulation of Labour Relations, all employees in the private sector are entitled to the following rights.

Annual Leave Entitlement
Article 29 — Federal Decree-Law No. 33/2021
  • 30 calendar days paid annual leave per year after completing 1 year of service
  • 2 days per month for employees who have completed 6 months but less than 1 year
  • Leave salary must be paid in advance before the employee takes their leave
  • Unused leave can be carried forward or compensated upon end of service
End of Service Gratuity
Article 51 — Federal Decree-Law No. 33/2021
  • 21 days' basic salary for each year of the first 5 years of service
  • 30 days' basic salary for each additional year beyond 5 years
  • Payable regardless of the reason for contract termination (with exceptions)
  • Calculated on basic salary only — excludes allowances and benefits
Sick Leave Rights
Article 31 — Federal Decree-Law No. 33/2021
  • 90 days sick leave per year (after completing probation period of 6 months)
  • First 15 days: full pay
  • Next 30 days: half pay
  • Remaining 45 days: unpaid
  • Employer cannot terminate an employee on medical grounds during sick leave
Working Hours & Overtime
Articles 17–20 — Federal Decree-Law No. 33/2021
  • Maximum 8 hours per day or 48 hours per week for regular employees
  • Reduced to 6 hours per day during the Holy Month of Ramadan
  • Overtime compensation: basic pay + 25% premium on regular overtime
  • Overtime between 10 PM and 4 AM: basic pay + 50% premium
  • Friday is the statutory weekly rest day (with exceptions for some sectors)
Maternity & Paternity Leave
Articles 30 & 32 — Federal Decree-Law No. 33/2021
  • Maternity leave: 60 calendar days — 45 days full pay, 15 days half pay
  • An additional 45 days unpaid leave for illness arising from pregnancy or childbirth
  • Paternity leave: 5 working days within 6 months of the child's birth
  • Employer may not terminate a female employee during maternity leave
Notice Period & Termination
Articles 42–44 — Federal Decree-Law No. 33/2021
  • Minimum 30 days notice for both employer and employee (standard contracts)
  • Termination without notice: only for gross misconduct as defined by law
  • Arbitrary dismissal: employee entitled to compensation of up to 3 months salary
  • Employee has right to 1 day per week (paid) during notice period to seek new work

Recruitment & Selection Policy
All recruitment at Bin Dhaen Holding is conducted on the basis of merit, qualifications, and experience. We follow a structured Request for Recruitment (RFR) process approved by department heads and senior management. External job postings are published on our official careers portal. Candidates are evaluated through a standardised multi-stage process including CV screening, AI-assisted assessment, face-to-face interview, and C-Level approval. We do not accept CVs via unauthorised channels. Referrals are welcome but must go through the official application process.

Confidentiality & Data Protection
All candidate information submitted through our portal is handled in strict confidence in accordance with UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021). Your personal data is used solely for recruitment purposes and is accessible only to authorised HR and management personnel. We do not share candidate data with third parties without explicit consent. Data is retained for a maximum of 24 months after the application process concludes.
Performance Management
All employees undergo a structured 6-month and annual performance review. Reviews assess key performance indicators (KPIs), behavioural competencies, and alignment with company values. Performance outcomes directly inform salary reviews, promotions, and training plans. Employees receive written feedback and have the right to discuss and appeal their evaluation with the HR Department. Consistently high performers are eligible for fast-track promotion.
Grievance & Disciplinary Procedure
Employees who have a workplace grievance should first raise it with their direct line manager. If unresolved within 5 working days, the matter may be escalated to the HR Department in writing. All grievances are investigated within 10 working days. Disciplinary actions follow a structured process: verbal warning → written warning → final written warning → termination, except in cases of gross misconduct. All disciplinary actions are documented and the employee has the right to respond at each stage.
Work from Home & Flexible Work
Select roles within administrative and IT functions may qualify for hybrid or remote working arrangements subject to departmental approval. Flexible working requests must be submitted in writing to HR and approved by the respective department head. Remote working does not alter an employee's contractual obligations or UAE Labour Law entitlements. All remote employees must maintain the same standards of conduct, productivity, and data security as office-based staff.
Travel & Accommodation Policy
Eligible employees receive an annual return economy class air ticket to their home country after completing one year of service. Company-provided or subsidised accommodation is available for selected roles as stated in the offer letter. Accommodation is subject to company housing guidelines and occupancy rules. Employees staying in company accommodation are expected to maintain the premises and vacate within 30 days of employment ending.
